Guidance under the revised law
Stakes · Whether implementing guidance under the new Counter-Espionage Law is broad, narrow, or delayed while cases pile up.
The Standing Committee has revised the Counter-Espionage Law. It broadens espionage toward documents, data, and items related to national security and intelligence. The text takes effect on 1 July 2023.
Spring raids have already touched foreign due-diligence firms in Beijing. Open reporting named Mintz Group and later scrutiny of Bain and Capvision. You must recommend implementing guidance to provincial offices and co-equal ministries.
Three minister-level choices:
1. Push broad guidance that matches the revised statute’s expanded scope.
2. Push narrow guidance that tells field offices to avoid sweeping foreign business files.
3. Delay public cases until MFA and the economic shops sign off.
Constraints of the office here
- — Ministerial and political level only. No raid methods or interrogation detail.
- — The Party centre sets the foreign-economic tradeoff.
- — Due-diligence firms appear as **signals**, not as tradecraft targets.
